Cross-Border Compliance Matrix: Seller Scenarios

How primary UK and European regulatory obligations apply depending on your brand's country of establishment and target marketplace.

Regulatory Area Scenario 1: US Brand → UK Scenario 2: US Brand → EU Scenario 3: UK Brand → EU
Product Safety (GPSR) Follows UK General Product Safety Regulations. UK address on label; GPSR applies if selling to Northern Ireland. Mandatory EU Responsible Person (RP). Packaging must list EU RP name, address, and localized warnings. UK entity cannot act as EU Responsible Person. Must appoint an EU-27 entity or authorized representative.
VAT Collection & Remittance Consignments ≤ £135: Amazon collects at sale. Domestic UK FBA requires UK VAT registration. Under IOSS (€150 limit) or local EU VAT registrations if holding stock in European fulfillment centres. Exports from GB to EU treated as third-country imports. Use IOSS, OSS, or local EU VAT in storage countries.
Packaging & EPR UK Packaging EPR applies if exceeding UK turnover and tonnage thresholds. Mandatory EPR registrations (Germany LUCID, France ADEME/CITEO). PPWR applies from 12 Aug 2026. Separate EPR registration required in each EU member state where packaging is introduced.
Low-Value Customs Duty N/A (UK customs duty applied based on UK Tariff schedule above £135). From 1 Jul 2026 to 1 Jul 2028: Flat €3-per-item duty on consignments ≤ €150 (Regulation (EU) 2026/382). MFN shipments from UK to EU consumers incur the flat €3 duty unless stock is held domestically inside the EU.
FBA Storage & Prime UK domestic FBA inventory pool. Separate from all European fulfillment networks since 2021. Pan-European FBA across 9 countries (requires local VAT where stored) or European Fulfillment Network (EFN). Stock must be physically exported and delivered into EU fulfillment centres to offer EU Prime delivery.

Frequently Asked Questions

Why is regulatory compliance critical for Amazon UK and EU expansion?

European marketplaces operate under strict statutory frameworks. Non-compliance with the General Product Safety Regulation (GPSR), Extended Producer Responsibility (EPR), or VAT regulations leads to immediate ASIN suppression, inventory blocking at customs, and Account Health degradation across Amazon's European stores.

Can SellerVine act as our legal representative or tax agent in Europe?

No. SellerVine is an Amazon operational and growth agency. We assist with Amazon Seller Central compliance execution, catalog attribute mapping, Account Health documentation submission, and pricing strategy. For statutory legal representation or tax filings, brands must engage qualified EU attorneys, Authorized Representatives, or certified tax advisors.

Does Pan-European FBA still include the United Kingdom?

No. The UK has not been part of Pan-European FBA since 1 January 2021 following Brexit. Sellers distributing stock across both the UK and the European Union must maintain independent inventory pools, separate freight shipments, and distinct customs clearances.

How does the EU General Product Safety Regulation (GPSR) affect US brands?

Regulation (EU) 2023/988 applies from 13 December 2024 to all consumer non-food products placed on the EU market. US sellers must appoint an EU-established Responsible Person, ensure physical packaging displays safety markings in destination languages, and register compliance documentation in Seller Central.
